Terms of Service
These Terms and Conditions (together with any other documents referred to) set out the terms and conditions on which we supply the bouquets listed on our website flowerchef.co and the flower Chef iOS and Android apps (individually a “Store” and collectively “Stores”) to you. Please read them carefully before ordering from our Stores. By ordering any of our bouquets, you agree to be bound by these Terms and Conditions.
The Stores are operated by Flower Chef Limited, a company registered in England and Wales under company number 10494615 with its registered office at Elcot, High Street, Seend Wiltshire, SN12 6NU, United Kingdom. Our VAT number is GB258285570.
All intellectual property rights concerning the Stores are owned by Flower Chef Limited. No content or trademarks may be reproduced, copied, used, sold, or duplicated without our prior written consent.
We reserve the right to withdraw or amend our Stores at any time. In using our Stores you agree to accept and abide by all of these Terms and Conditions and act in accordance with the law. You may not alter, impair or interfere in any way with our Stores.
The prices of bouquets are as quoted in our Stores from time to time except in cases of obvious error. Prices are liable to change at any time.
By placing an order through our Stores, you warrant that you are legally capable of entering into binding contracts and you are at least 18 years old.
All orders are subject to acceptance and availability. Orders placed by you are an offer to purchase and may be accepted by us, subject to stock availability and authorisation of your payment.
You recognise that our ability to deliver the bouquets is dependent on the accuracy of the recipient’s name and address details which you supply when ordering from our Stores. We shall not be liable for delayed or non-delivery caused by inaccurate or incomplete delivery details.
Deliveries to hospitals, schools, business addresses and the like will be delivered to the main reception or mailing room. If sending to a hospital, please check in advance whether it will accept fresh flowers for delivery to the wards.
Our carriers will wait for a maximum of ten (10) minutes at the delivery address after which we will try to contact you by telephone to ask whether you wish the carrier to continue to wait (at extra cost, chargeable to your payment card) until the recipient is available. Alternatively you may request the carrier to leave the bouquet in as suitable location as possible at the delivery address. If we are unable to contact you the carrier will leave the bouquet in as suitable location as possible at the delivery address. In either case, you accept that the time of delivery is when the bouquet is left.
Risk transfers to you at the time of delivery.
Provided Flower Chef Limited and any carriers subcontracted by us use reasonable efforts to deliver bouquets on time, we will not be responsible for any late or failed deliveries. For the avoidance of doubt, time of delivery is not of the essence and we shall not be liable for any indirect, consequential or special loss arising from late or failed deliveries.
We shall not be liable for any loss, damage, failure to perform or delay in performing any of our obligations due to unforeseen circumstances or those beyond our reasonable control.
Cancellation, Returns and Refunds Policy
Because flowers are perishable goods your order cannot be cancelled once accepted and cannot be returned after delivery.
We guarantee our bouquets for five (5) days from delivery provided that the care instructions are followed. We endeavour to dispatch all bouquets in perfect condition but in the unlikely event that your bouquet has been damaged in transit please keep it and contact us within 24 hours of receipt, if possible with a photograph showing the damage. Unfortunately, claims reported outside of this time cannot be considered. Wherever possible we will replace damaged bouquets but at our option we may offer a full refund.
We reserve the right to vary these Terms and Conditions from time to time and you will be subject to the policies and terms and conditions in force at the time that you order products from us.
Contracts for purchases through our Stores will be governed by English law. Any dispute arising from, or related to, such contracts shall be subject to the exclusive jurisdiction of the courts of England and Wales.
When you purchase from our Stores, we collect the personal information you give us such as your name, email address and telephone or mobile number, billing and delivery address and your credit or debit card details. Your card details are securely stored by our payment processing partner using their bank grade encryption.
When you browse our Stores, we automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.
When you provide us with personal information to complete a transaction, verify your credit card, place an order or arrange for a delivery, we imply that you consent to our collecting it and using it only for that specific purpose.
If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your consent or provide you with an opportunity to withhold it. You can change your mind at any time and withdraw your consent for us to contact you and for the continued collection, use or disclosure of your information by contacting us at firstname.lastname@example.org or by post to Flower Chef Limited, Elcot, High Street, Seend, Wiltshire, SN12 6NU, United Kingdom.
Your personal information is treated by us as confidential and will not be disclosed to unconnected third parties unless we are required by law to do so.
We will only disclose your personal information to third-party providers used by us to the extent necessary to allow them to perform the services they provide for us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect of the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the way in which your personal information will be handled by them. In particular, certain providers may not be governed by the laws of the jurisdiction which applies to either you or us. If you elect to proceed with a transaction which involves a third-party service provider, your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.
Our Stores are hosted by Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored in Shopify’s data storage, databases and the Shopify application. Your data is stored on a secure server behind a firewall.

The Stores may, from time to time, contain links to websites of partner networks and affiliates. If you follow a link to any of these websites please note that they have their own privacy policies and we do not accept any responsibility or liability for those policies.
To protect your personal information we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

Sessional cookies are stored on the user's computer memory for the duration of the time you spend on the website. They ensure you can navigate around the website without having to repeatedly log in. These cookies are not accessible once you have left the website and are automatically deleted when the browser is shut down.
Persistent cookies are stored on the user's computer memory so your details will be remembered when you next visit the website. They are also used to track the number of visitors, average time on the site and shopping behaviour.
